COURT ORDERS GOV FEYEMI TO PAY SACKED CHAIRMAN, FCSC ENTITLEMENT AND ALLOWANCES

A High Court in Ado-Ekiti just ordered Gov. Fayemi to pay the sacked Chairman of the State Civil Service Commission, Chief Kunle Ogunlade and other members of the commission all their entitlements and allowances up to the end of their tenure.
These entitlement and allowances is about N100 million.
Immediately Fayemi assumed office, he sacked Ogunlade and four other members of the commission, who were appointed by the Segun Oni-led government in a radio broadcast.Read on after the cut.
Delivering judgement today, Justice C.I Akintayo held that "the Chairman and members of the Civil Service Commission cannot be removed nor their tenure terminated. That the Governor and the Attorney General have no power to remove the Chairman and members of the Civil Service Commission. That the Governor and the Attorney General are bound by the provision of the constitution. That the purported dissolution by radio announcement is contrary to section 199 and 201 of the constitution and is therefore illegal, ultra vires, null and void. That the purported radio announcement is unlawful, ultra vires, null and void and of no effect."
Justice Akintayo consequently upheld the alternative claims and therefore ordered that the Chairman and members of the Civil Service Commission should fully be paid all their entiltlements and allowances upto the end of their tenure.
